C.R.M. (M) 161 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, in connection with Bhadreswar Police Station Case No. 462 of 2024 dated 23.11.2024.

And In Re :

Md. @ Mohammad Imran ... Petitioner.

Mr. Suman Chakraborty Mrs. Jyoti Agarwal ... for the Petitioner Mr. Joydeep Biswas Mr. Abhinaba Mukherjee ... For the State Memo of evidence submitted by the State is taken on record.

Learned counsel for the petitioner submits that the petitioner is in custody for about 126 days. Charge sheet has been submitted. He shall cooperate in trial of the case. He prays for bail.

Learned counsel for the State opposes the prayer and submit that the petitioner is a part of a racket which has helped several persons to obtain fake passports in lieu of huge amount of money. Several lakhs of rupees have been transferred to the account of the petitioner from the passport applicants for a period of five years. The petitioner is a traffic home guard and has criminal antecedents to his credit. I have considered the material on record.

Upon consideration of the fact that sufficient incriminating material has transpired against the petitioner connecting him to the alleged offence and also since chances of the petitioner influencing witnesses and winning them over if released on bail at this stage cannot be ruled out prayer for bail of the petitioner is rejected at this stage. The application is disposed of.

Case Diary is returned.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
