Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 7 months and the subject matter of the case relates to alleged recovery of 170 bottles of Fairdyl cough syrup from his possession. According to the petitioner, some of the accused persons are still absconding and there is no scope of the trial commencing in near future and the prosecution intends to examine 14 witnesses in order to prove its case so far as the charge-sheet is concerned. Learned advocate for the State opposes the prayer for bail.

Having considered the period of detention, quantum of seizure as well as the number of witnesses cited, I am of the view that there is no possibility of the trial being taken to its logical

conclusion. As such, the prayer for bail of the petitioner is allowed. The petitioner, namely, Nurol Islam shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- (Rupees Ten Thousand) each, one of whom must be local to the satisfaction of the learned Special Judge, (under NDPS Act)-cum learned Additional Sessions Judge, 3rd Court, Balurghat, Dakshin Dinajpur. If on bail, the petitioner shall be physically present on each and every date fixed by the learned special court and shall not leave the jurisdiction of the district of Dakshin Dinajpur without prior permission of learned special court.

Accordingly, CRM(NDPS) 707 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
