The petitioner no. 1 claims to be a registered trade union under the Trade Union Act, 1926. Being aggrieved with the notice before withdrawal/cancellation of the certificate of Registration issued in Form-E dated 24th June 2022, the present writ application has been filed.

During pendency of the present writ application, Mr. Bandyapadhyay, learned advocate appearing for the State has placed before this Court, an order in FormF dated 28th October 2022 issued by the Registrar of Trade Unions, thereby canceling/withdrawing the certificate of registration issued in favour of the petitioner no. 1.

Today, Ms. Samanta, learned advocate appearing for the State authorities, on instruction submits that the aforesaid order in Form-F has already been communicated to the petitioner no. 1 by an e-mail communication dated 12th May 2023. In support of her aforesaid contention, she places before this Court a photocopy of the e-mail communication and

the order in Form-F dated 28th October 2022. Let the aforesaid documents be taken on record.

Having regard to the aforesaid, I am of the view that the present writ application cannot be proceeded further, since a final order in Form-F has already been passed.

Accordingly, the writ petition being WPA no. 8599 of 2023 is disposed of without any order as to costs. 6.

The petitioner shall, however, be at liberty to take appropriate steps insofar as the order in Form-F dated 28th October 2022 issued by the Registrar of Trade Unions, West Bengal is concerned.

Urgent photostat certified copy of this order, if applied for be given to the parties on priority basis upon completion of requisite formalities.
