The petitioner, to that effect, informed the police authorities, but no action has been taken.

Learned advocate for the State has submitted a report which reflects that the learned Civil Judge, Berhampore, Murshidabad has already passed an order of injunction. Consequently, the police authorities have also drawn up a proceeding under Section 126/135(3) of the BNSS to avoid any breach of the peace.

Since the learned Civil Court is

already in seisin of the issues, as such, in respect of right, title, interest and usages of the property is concerned, the petitioner, if so advised, would approach the civil court and, if there are any infraction of the status quo order, the petitioner would, if so advised, also approach the concerned civil court for a direction upon the police authorities for rendering police assistance for violation of the status quo order.

In the meantime, the police authorities would ensure that there is no breach of the peace and/or tranquility taking place as also no untoward incident resulting because of the strained relationship existing between the parties.

With the aforesaid observations, WPA 8597 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with

the record. A copy of the report be handed over to the petitioner.
