Ms. Sumita Shaw Mr. Nilendu Bhattacharya Mr. Soumen Chatterjee ...for the petitioner Mr. Suman Dey Ms. Rajyashree Mukherjee ...for the Council Admittedly, the relevant Pharmacy College was granted affiliation for the academic session 2023-24 by a letter dated January 8, 2024, from respondent no.3.

As per the admission schedule, the petitionercollege had the scope to admit students only on 20th January, 2024 and 22nd January, 2024. The petitioner could admit 18 students only on those two specified dates.

By filing this writ petition, the petitioner-college submits that the college has strength of 60 students and it should be given a further opportunity to fill up the remaining vacant seats.

I am not inclined to grant such prayer. It is an admitted position that the first internal examination has already been completed in the month of April, 2024. The second internal assessment is scheduled to be held in the month of July, 2024. The students

cannot be allowed to take part in the relevant examinations without attending the required number of classes. At this juncture, if the college is permitted fresh students, they will not be a position to undergo the required number of classes.

I, however, make it clear that for the upcoming session i.e. 2024-2025, if the institute makes any application for affiliation, the council should process the same in accordance with law before the commencement of the said academic session.

Accordingly, WPA 9303 of 2024 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
