Alleging illegal construction at the behest of the respondent nos. 6 and 7 at the petitioners' premises details whereof have been provided in paragraph 2 of the writ petition, and the failure on the part of the Municipal Authorities to act on the basis of the petitioners' complaints, the present writ petition has been filed.

Despite service the private respondents are not represented.

Having heard the learned advocates appearing for the respective parties, I am of the view, having regard to the case made out, it shall be prudent at the stage to direct the municipality to take a decision on the

basis of the petitioners' complaint in accordance with law by passing a reasoned order within two weeks from the date of communication of this order, upon hearing all concerned, and if, the municipality notes any illegal construction or any construction dehors the sanctioned building plan, appropriate steps be taken in accordance with the provisions of Section 218 of the West Bengal Municipal Act, 1993.

It is expected that the proceedings in this regard will be concluded by the municipal authorities within eight weeks from the date of communication of this order.

Under all ordinary circumstances, the proceedings shall be concluded within twelve weeks from the date of communication of this order. 7.

Since, no affidavit has been called for, the allegations made in the writ petition are deemed not to have been admitted.

With the above observations, the writ petition is disposed of.

Urgent photostat certified copy of this order, if applied for, be made available to the parties upon compliance of requisite formalities.
