Earlier this revisional application was called on 05.12.2023 when an accommodation was sought for on personal grounds of the learned advocate of the petitioner. Today also when the revisional application is called, learned advocate for the petitioner submits that his case records are misplaced.

I find from the contents of this revisional application that the subject-matter related to challenge in respect of the charge-sheet No.

24/2023 dated 26.01.2023 filed in connection with Burdwan Police Station Case No. 1429 of 2022 dated 13.12.2022 which was registered for investigation under Sections 341/323/509/379/34 of the Indian Penal Code read with Section 3(1)(r)(s) of the SC and ST (POA) Act, 1989.

Having regard to the nature of the documents so enclosed without the documents under Section 207 of the Code of Criminal Procedure being made available before this Court after the charge-sheet being submitted, I am of the view that no interference can be made at this stage as the prosecution case which is required to be adjudicated has not been placed in a proper manner.

The petitioners are granted liberty to take up the issues canvassed in the present revisional application at the appropriate stage of the trial.

With the aforesaid observations, the revisional application being CRR 1290 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
