Banerjee) Mr. Soumyadeb Sinha Mr. Raunak Bose ...for the petitionerss This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Division), 1st Court at Alipore to dispose of an application under Order 12 Rule 6 of the Code of Civil Procedure within a specified timeframe.

The learned advocate appearing for the petitioner submits that the hearing of the said application was being adjourned from time to time at the instance of the principal defendants.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate on record of the petitioner shall be obliged to forward a copy of this application along with a copy of this order, upon the opposite parties or

the learned advocate representing the opposite parties before the learned trial Judge.

From the order-sheets appended to this civil revision application this Court finds that May 6, 2025 has been fixed for filing show-cause by the defendant no. 1 and hearing of the petition under Order 12 Rule 6 of the CPC and for filing written objection in the meantime.

The learned advocate for the petitioner submits that the written objection to the application under Order 12 Rule 6 of the CPC has been filed by the defendants in the meantime.

In the light of the aforesaid submission made by the learned advocate for the petitioner, CO 1325 of 2025 is disposed of by requesting the learned Civil Judge (Sr. Division), 1st Court at Alipore to take up the hearing of the application under Order 12 Rule 6 CPC on the next date fixed, if the same is otherwise ready for hearing and to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
