1. The petitioner does not have a case for a direction on the State respondents to hold a fresh tender.

2. The petitioner's contract as the supplier for grocery items for the inmates of a State Welfare Home situated in Bankura came to an end on 31st March, 2023. The State respondents decided to source the grocery and vegetables from a State franchised organization in the interregnum until a fresh tender is called.

3. There is nothing on record to show that the petitioner will be precluded from participating as and when the fresh tender is called. At best the petitioner's representation made to the Chairman

of the Tender Committee, Bankura on 1st April, 2023 may be considered by the concerned respondents.

4. WPA 8615 of 2023 is disposed of with a direction on the respondent no. 3 being the Chairman, Tender Committee and Additional District Magistrate, Bankura to consider and dispose of the representation made by the petitioner on 1st April, 2023 within three weeks from date by way of a reasoned decision which should be communicated to the petitioner within a week from the date on which the reasoned decision is taken.

5. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
