In the matter of : Pritam Saha ..... petitioner Mr. Prabir Majumder ....For the petitioner Ms. Sukanya Bhattacharyya Mr. Mirza Firoz Ahmed Begg .....For the State It is submitted by the learned advocate for the petitioner that he was granted bail in connection with G.R. Case No. 3139 under Sections 399/402 of the Indian Penal Code and Sections 3/4 of the Explosive Substances Act, 2008, pending before the learned Chief Judicial Magistrate, Nadia.
It has been further submitted that after filing of the chargesheet, the date was fixed for appearance of the petitioner, but since he was ill, he could not attend the Court on that date. Learned Magistrate in the Court below issued a warrant of arrest against him.
Since the learned advocate for the petitioner submits that the petitioner is ready and willing to surrender on any date as specified by this Court, this revisional application is disposed of with a direction that the petitioner shall surrender before the learned Magistrate in the Court below within a period of six weeks from date.
The warrant of arrest issued against the petitioner shall remain stayed for a period of six weeks from date.
In the event the petitioner surrenders before the learned Magistrate in the Court below, his bail prayer will be considered in accordance with law.
If the petitioner does not surrender before the learned Magistrate, the warrant of arrest shall revive and the learned Magistrate will be at liberty to execute the same in accordance with law.
The application being CRR 1152 of 2021 is disposed of. All parties shall act upon the server copy of this order duly downloaded from the official website of this Court. (Kausik Chanda, J.)
