The appellant is not represented.

It appears from the application for condonation of delay, being CAN 1 of 2025, that in paragraphs 13 and 15, there are blanks and we wonder how the Commissioner of Affidavit, High Court, Appellate Side, Calcutta could allow affirmation with blanks. Although, it is mentioned in Paragraph 20 that there is a delay of 167 days, however, we find from the report of the Stamp Reporter that there is a delay of 190 days. This appeal and the connected applications appear to have been filed after the notice of contempt has been served upon the appellant.

Moreover, it appears that persons similarly placed have received the benefits.

On such consideration, we are of the view that the application for condonation of delay is not bona fide. Moreover, the impugned order passed in favour of the petitioner does not suffer from any infirmity.

Accordingly, the application for condonation of delay is dismissed.

In view of dismissal of the application for condonation of delay, the appeal and the connected application are also dismissed.

However, there shall be no order as to costs. 7.
