Mr. Pravas Bhattacharya and Mr. Bidyut Kumar Ray, learned advocates who usually appear for the State are present and found representing the State. The appointment of learned advocates may be regularized by the concerned authority in this matter.
This criminal revisional application under Section 401 read with Section 482 of the Code of Criminal Procedure has been filed by the petitioner challenging order dated 15.02.2011 passed by Learned Additional Chief Judicial Magistrate, Barrackpore in Jagatdal Police Station Case No.338 of 2010 (MP Case No.678 of 2010). After filing of the revisional application, the petitioner on
15.06.2011 was directed to serve notice upon the State. There has been no compliance of such order till date.
The petitioner appears to be disinclined to proceed with the revisional application for which no step has been taken by him in 10 years time. There is no interim order.
In my considered view, the purpose of this revisional application has been rendered futile and the same is dismissed for default.
Let a copy of this order be sent to the Court of Learned Additional Chief Judicial Magistrate, for information. Urgent photostat certified copy of the order, if applied for, be supplied to the parties on compliance of necessary formalities. (Ananda Kumar Mukherjee, J.)
