Ms. Sonali Das ..for the petitioner This revisional application has been filed by the defendant no.2/petitioner in Title Suit No.455 of 2015, pending before the learned Civil Judge, Junior Division, 6th Court, Alipore, District South 24 Parganas. The petitioner prays for expeditious disposal of the application pending under Order 6 Rule 17 of the Code of Civil Procedure as also the Title Suit No. 455 of 2015.

Records reveal that the application under Order 6 Rule 17 of the Code of Civil Procedure as also the application for temporary injunction pending before the learned Court below are pending.

Having considered the records, this Court is of the opinion that the justice would be sub-served if the learned Court below is directed to dispose of all the pending applications upon giving one last chance to the contesting parties to file their written objections, if the same have not been filed.

This Court has not gone into the merits of

claims and counterclaims of the parties and the learned Court below shall dispose of the said application within a period of six months from the next date fixed without granting any unnecessary adjournments to either of the parties on their own merits and in accordance with law. Upon disposal of the said application, the learned Court below shall make attempts to dispose of the suit expeditiously.

This revisional application is disposed of.

The petitioner is directed to serve copies of the revisional application along with the server copy of this order upon the opposite parties and also the learned Advocate for the opposite parties in the learned Court below within a week from date.

There will be however no order as to costs.

Urgent photostat certified copy of this order be given to the parties on priority basis, if the same is applied for.
