The property of the petitioners has been utilised for the purpose of installation of towers and drawing overhead transmission lines through the property of the petitioners. The learned advocate appearing for the petitioners draws the attention of the Court to the order of the District Magistrate, Hooghly dated March 5, 2020 and submits that in spite of a specific directions passed by the District Magistrate, Hooghly, the compensation amount has not yet been determined by the respondent authority. Mr. Chaturvedi, learned senior advocate submits that in the meantime an inspection has already been conducted and since the petitioners have made a claim for

compensation de hors the provisions of the relevant statute, the compensation amount has not yet been paid. Such submission is disputed by the learned advocate for the petitioners. She submits that the petitioners have only claimed compensation as per the provisions of the relevant statute.

Since the property has been utilised for the purpose of erection of a pillar and for drawing the overhead transmission lines, the petitioner is entitled to compensation as per the relevant statute and the Powergrid Medinipur Jeerat Transmission being the appropriate authority is duty bound to ascertain the compensation amount, if any, for the damage caused to the property.

At this stage, the learned advocate for the petitioners submits that a liberty be given to the petitioner to submit a comprehensive representation for payment of compensation amount before the concerned authority. In the light of the submission made by the learned advocate for the respective parties, WPA 9357 of 2024 stands disposed of by giving liberty to the petitioners to submit a comprehensive representation before the Powergrid Medinipur Jeerat Transmission, being the respondent No.3 and if such a representation is submitted, the competent authority of the respondent No.3 shall consider and dispose of the same by passing a reasoned order as expeditiously as possible but positively

within a period of 6 weeks from the date of receipt of a server copy of this order along with a copy of the representation permitted to be submitted by this order. There will be no order as to costs.
