Basu Mallick ... for the State The Principal Secretary, School Education Department, in compliance of the order passed by the Court, allowed the benefit of granting consequential relief and incremental benefit to the petitioner notionally with effect from November, 2013. For implementation of the grant of monetary benefit consequent to the aforesaid direction, the file was forwarded to the Finance Department. The Finance Department rejected the prayer of the petitioner which has, in effect, set at naught the benefit allowed by the Principal Secretary. The manner in which the Finance Department has rejected the prayer of the petitioner, appears to be prima facie contrary to the order passed by the Hon'ble Court.

However, since the matter is before this Bench under the Special Jurisdiction (contempt) and the

Finance Department is not impleaded as party in the contempt application, accordingly, the contempt application stands disposed of by granting liberty to the petitioner to approach the competent forum for redressal of her grievances.

The contempt application stands disposed of.

Let the documents handed over by the learned advocate representing the alleged contemnor, be retained with the record.
