Let a copy of this application be served upon Ms. Purnima Ghosh, learned counsel, who ordinarily appears on behalf of the State. She is requested to represent the State in this case. Her engagement may be regularized in due course.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the de facto complainant in this case. He lodged an instant FIR on 21.01.2019, inter alia, under Section 307 of the Penal Code. Later on, Section 302 of the Penal Code was added to the array of charges. A charge sheet was submitted in April 2019. But, till date the matter could not even be committed to the Sessions. All the accused are not appearing. They are taking turns in absenting themselves. Warrant of arrest has been issued against one.

Heard the learned counsel for the State.

No prejudice will be caused to anyone if a direction is passed to expedite the proceeding.

It appears that after submission of charge sheet, since April 2019, there is an inordinate delay in conducting the proceeding. If accused are absconding or taking turns in remaining absence, appropriate steps ought to be taken by the learned Court to ensure the attendance of the accused.

Let the Court take prompt and necessary action in this regard at the earliest.

In view of the above and in the interest of justice, the Court is further requested to conclude the proceeding of supply of copies and commitment upon the accused after ensuring their attendance in accordance with law and as expeditiously as possible, preferably

within six months from the date of communication of this order. With these observations, the revisional application is disposed of.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.) ssi
