Petitioners are aggrieved by the fact that inspite of the direction passed in T.S. 293/2015 upon the Frezerganj Coastal Police Station, the Officer-in-Charge did not give effect to the directions passed by the learned Civil Judge (Junior Division), Kakdwip.

I find from the records that the next date was fixed on 7th of February, 2025.

Learned advocate appearing for the private respondents no. 11 to 15 submit that they are also cosharers and they are cultivating their own land, unnecessarily the petitioners have entered into a dispute and are trying to impose themselves upon the property of the petitioners.

Be that as it may, presently I find that the direction has been passed upon the Officer-in-Charge,

Frezerganj Coastal Police Station, police authorities have also come to an assessment that there is disturbance at the area and as such have drawn up proceedings under Section 126 of be BNSS.

So far as the issue relating to any inconveniences being faced by the Officer-in-Charge, Frezerganj Coastal Police Station, I am of the view that if he faces any inconveniences he must inform the learned Civil Judge (Junior Division), Kakdwip. In the alternative he would ensure that there is no violation of the said order passed by the Civil Court, until and unless the same is altered by the same Court or any higher forum.

Police authorities have already kept surveillance and they would continue the same and would ensure that no breach of the peace and/or tranquility and/or any untoward incidents results because of the strained relationship existing between the parties.

With the aforesaid observations WPA 8654 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to both the parties.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
