27.09.2022 rc/ct.no.10 Item No.77 WPA No. 8213 of 2022 Mr. Sougata Mitra Mrs. Ankita Dey Mrs. Jahanara Begam ...for the petitioners Mr. Soumitra Bandyopadhyay Mr. Priyabrata Batabyal ....for the State Being unhappy with the assessment of compensation made by the State-respondents in favour of the petitioners upon acquiring their land, the petitioners submitted an application under Section 18 of the Land Acquisition Act, 1894 (hereinafter referred to as "the Act of 1894") before the authority for reference to the Court for assessment of the same. The petitioners submit that the said application has not been referred till date. Upon consideration of the submission made by the learned counsels appearing on behalf of the parties the writ petition is disposed of directing the 2nd respondent to refer the LA Case to the Land Acquisition Court, Purulia under Section 18 of the Act of 1894 within four weeks from the date of communication of this order.

With the above observations and directions this writ petition is disposed of.

There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted.
