Petitioner is in custody for more than four years. He prays for bail on the ground of delay.

Learned Advocate for the State opposes the bail prayer. He submits delay was due to circumstances beyond the control of the prosecution. On such ground, bail prayer of co-accused viz., Rintu Khan was turned down.

We have considered the materials on record. Coaccused viz., Rintu Khan prayed for bail on the ground of delay was turned down. Petitioner stands on the same footing. Hence, we are not inclined to favourably entertain his prayer for bail.

Accordingly, the prayer for bail of the petitioner is rejected at this stage.

Trial court is directed to conclude the trial as expeditiously as possible without granting unnecessary adjournment to either of the parties.
