Petitioner submits there is inordinate delay in trial. Accordingly, he prays for bail.

Learned Advocate for the State opposes the bail prayer. He submits nine out of ten prosecution witnesses have already been examined. As the trial is at its fag end and the recovery from the joint of petitioner and co-accused is above commercial quantity i.e. 46.5 kgs. of ganja, we are not inclined to grant bail to the petitioner.

Under such circumstances and in view of statutory restrictions under Section 37 of the NDPS, Act we are not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.
