The petitioner seeks parity with co-accused who has been granted bail earlier.
Learned counsel for the petitioner submits that the petitioner is in custody for about seventy-three days.
The State does not dispute the fact.
In view of the fact that the petitioner is similarly circumstanced with the co-accused who has been granted bail earlier, the petitioner is entitled to the same benefit. Accordingly, the prayer for bail is allowed.
The petitioner namely Pritam Mitra @ Arko be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Chandannagore, Hooghly subject to the condition that he shall remain within the jurisdiction of Bandel police station and shall meet the Investigating officer once a week till submission of charge sheet. The petitioner shall not intimidate witnesses or tamper with evidence in any manner whatsoever.
In the event the petitioner fails to comply with any of the conditions as stated above without justifiable cause, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
The application for bail is disposed of.
