Some coaccused have already been granted anticipatory bail and bail. The petitioners have been falsely implicated in this case. There was a delay in lodging the FIR.
Learned counsel for the State opposes the prayer for anticipatory bail and relies on the statements of the victims recorded before the learned Magistrate and the injury reports. He submits that a lady, who was in the family way, was brutally assaulted, resulting in bleeding injuries. He also refers to the statements of local witnesses. Two other female co-accused have been granted anticipatory bail by the learned Sessions Court.
Considering the above, the other materials available in the case diary, the alleged role ascribed to each of the present petitioners and the fact that the petitioner No.2 is an aged lady, while I am inclined to grant anticipatory bail to the petitioner No.2, the application for anticipatory bail of the petitioner Nos.1, 3 and 4 (Anil Bauldas, Dayal Bauldas and Jaydev Bauldas @ Joydeb Bauldas) is rejected. In the event of arrest, the petitioner No.2 (Susanti Bauldas @ Sushanti Bauldas) shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioner No.2 shall cooperate with the investigation and shall not threaten or intimidate witnesses. The application for anticipatory bail is, thus, disposed of.
