Petitioner has approached this Court as she was aggrieved by the inaction of the police authorities, particularly with respect to the communication which was made to the Inspector-in-Charge, Burdwan Police Station on or about 18.02.2025.

State has submitted a report which reflects that the police authorities have already registered the case being Burdwan PS Case no. 432/25 dated 20.04.2025 against Mihir Chatterjee and four others.

Police authorities have also examined available witnesses and issued notices under Section 94 of the BNSS and notices also under Section 35(3) of the BNSS have been issued. Having regard to the fact that the investigation of the case have commenced and the police authorities in order to prevent any breach of the peace has drawn up proceedings under Section 126/135 of the BNSS, I am of the view that prima facie, the grievance of the petitioner

in respect of both the cognizable offence as well as prevention of breach of the peace has been taken care of by the police authorities. As such further pendency of the writ petition is unwarranted. Police authorities will take the investigation of the case to its logical conclusion within a reasonable period of time, With the aforesaid observations WPA 8630 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

A copy of the report without enclosures be handed over to the learned advocate appearing for the petitioner. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
