The petitioner has filed the present writ application challenging the rejection of the tender of the petitioner on the ground that the petitioner is not having the experience in terms of the tender document.

Learned counsel for the petitioner submits that as per the tender notice issued by the respondent authorities for supply of grocery and store items of the year 2026-27 at Zoological Garden Alipore, the petitioner has participated in the said tender having its requisite qualifications but the respondents have disqualified the petitioner on the ground that the petitioner is not having the experience in such nature of work in wildlife parks/zoos.

The petitioner has relied upon the certificate issued by the Officer-in-Charge, Kolkata Police Dog Squad, Detective Department, Kolkata dated April 1, 2026 wherein it is certified that the petitioner is supplying dog diet to

Kolkata Police Dog Squad since 2015 to March 01, 2024. He submits that in spite of submitting the said document, the respondent authorities have not considered the said document and have disqualified the petitioner for participating in the said tender.

Learned counsel for the respondent authorities has brought to the notice of this Court to the condition of the tender document wherein it is mentioned that "Intending tenderers should produce credentials of two similar nature of completed work, each of minimum value of 30% of the estimated amount put to tender during five years prior to the date of issue of the tender notice". He submits that the petitioner has relied upon the certificate issued by the Officer-in-Charge of the Kolkata Police Dog Squad wherein the petitioner is supplying dog diet to Kolkata Police Dog Squad but the petitioner has not produced the document of two similar nature of completed work each of minimum value of 30 per cent of the estimated amount.

Learned counsel for the petitioner also failed to show that the petitioner has the document of the similar nature of work, each of minimum value of 30 per cent of the estimated amount put to tender during five years prior to the date of issue of the tender notice.

Considered the submissions made by the learned counsel for the respective parties. Perused the materials on record, the order of disqualification, the certificate relied by the petitioner issued by the Officer-in-Charge, Kolkata Police Dog Squad and the condition of the tender.

This Court finds that the petitioner has only relied upon the certificate issued by the Officer-in-Charge, Kolkata Police Dog Squad wherein the petitioner is supplying the dog diet to the Kolkata Police Dog Squad but the petitioner is not qualified the terms and conditions of the tender document by producing certificates of the two similar nature of completed work each of minimum value of 30 per cent of the estimated amount put to tender for the last five years prior to the date of issue of the tender notice.

Considering the above, this Court does not find any merit in the present writ application. Accordingly, WPA 9026 of 2026 is dismissed.

There shall, however, be no order as to costs.
