The State of West Bengal Mr. Parvej Anam Ms. Rituparna Ghosh ...for the Petitioner In this application, the petitioner has prayed for direction upon the court below for expeditious disposal of G.R. case no. 11993 of 2022, presently pending before the learned Judicial Magistrate, 4th Court, Barrackpore. Being aggrieved by the long pendency of the proceeding, learned counsel for the petitioner submits that the defacto-complainant lodged FIR on 13.12.2022 and thereafter the charge-sheet was submitted after completion of investigation on 13th January, 2023. The charge was framed by the Trial court on 2nd December, 2024 and the prosecution proposes to examine seven witnesses. However, the prosecution failed to examine a single witness till date and as such, he prayed for appropriate direction upon the court below for expeditious disposal.

Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party/State will have no cause to prejudice and as such, the service of copy of application upon the opposite party/State is hereby dispensed with.

Having heard learned counsel for the petitioner and that the prayer made by the petitioner is justified in view of the long pendency of the proceeding, the instant application being CRR 1751 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the aforesaid G.R. case no. 11993 of 2022 and to make best effort to conclude the trial preferably within a period of six months from the next date of hearing.

This order is passed invoking this court's jurisdiction under Section 529 of the BNSS.
