Mr. Kushal Paul...............for petitioner This criminal revision petition impugnes order dated 30th March, 2021 of Executive Magistrate, North 24 Parganas, Barasat passed in connection with G.D.E. no. 9522985 dated 16th March, 2021 under sections 107/116(3) Cr.P.C. Mr. Paul, learned advocate appears on behalf of petitioner and submits, complainant is his client's niece, who is one of the defendants in long pending title suit no. 24 of 2002 pending before Civil Judge (Junior Division), Barasat. Adjudication by the civil Court is being obstructed by complainant/defendants. His client was compelled to approach this Court exercising civil revisional jurisdiction and obtained order dated 12th February, 2021 from the revisional Court in C.O. 274 of 2021 (Goutam Kumar Biswas vs. Osmita Mitra & Ors.). However, the Magistrate has relied upon purported police report to require his client to file show cause as to why he should not be directed to execute bond as security for good behaviour.

Petitioner will file show cause before the Magistrate enclosing said order dated 12th February, 2021 as well as this

order. The Magistrate will consider the cause and come to a finding as to whether it is a fit case for direction upon petitioner to execute bond for good behaviour.

The criminal revision petition is disposed of as above. (Arindam Sinha, J.)
