Md. Hafiz Ali ... For the Petitioners Despite service, no one represents the State of West Bengal.

The petitioners are Anganwadi workers who have retired from service between 2014 and 2022.

By an office memo dated September 30, 2020 passed by the Joint Secretary, Department of Women and Child Development and Social Welfare, Government of West Bengal the Anganwadi Worker (AWW) and the Anganwadi Helper (AWH) of both Government run and NGO run Integrated Child Development Scheme (ICDS) Projects whose services were terminated after attaining of the age of 65 years on and from September 30, 2020 were held to be eligible for awarding of one time terminal grant of Rs.3 lakh.

It is submitted on behalf of the petitioners that despite rendering same service, the petitioners have not been considered "eligible" for grant of such one time award, causing immense prejudice to the petitioners. The petitioners have made a representation before the authorities concerned in July 20, 2022. Such representation has not been considered till date.

Considering the submissions made on behalf of the petitioners, this Court is of the view that the representation of the petitioners will considered by the respondent no. 3/the Directorate of Integrated Child Development Service within a period of 8 weeks from date. A reasoned order be passed and intimated to the petitioners within two weeks of passing thereof.

With the directions aforesaid, W.P.A. 8649 of 2023 is disposed of.

Since no affidavits have been directed to be exchanged in the present writ petition, all the allegations contained in the petition are deemed not to have been admitted by the parties.

All parties shall act on the server copy of this order duly downloaded from the website of this Court.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all the formalities.
