The petitioner is aggrieved by the fact that in spite of informing the police authorities regarding the activities of Pradhan of Kalinagar Gram Panchayat wherein it has been contended that for issuing recommendation letter, the said Pradhan demanded bribe and/or illegal gratification. To that effect, information was furnished to the Inspectorin-Charge, Uluberia Police Station, but till date no action has been taken.

State has submitted a report which reflects that the SDPO in-charge of Uluberia Police Station conducted an enquiry. However, no evidence was forthcoming from the petitioner.

So far as the other issues are concerned, police authorities have taken steps and the

petitioner's wife and other family members in respect of an incident were rescued and to that effect, Uluberia Police Station Case No. 75/2025 dated 14.02.2025 was registered for investigation. In case the petitioner has materials in his possession or chain of circumstances leading to the accusation complained of against the Pradhan is concerned, petitioner would be at liberty to approach the jurisdictional court under the relevant provisions of law. Learned Magistrate would consider the same on the basis of materials so produced and exercise his discretion by adhering to the provisions of law.

Since a proceeding under Section 126 of BNSS has been drawn up by the police authorities, police authorities would ensure that no breach of the peace or tranquility takes place at the locale and/or any untoward incident results because of the strained relationship existing between the parties.

With the aforesaid observations, the writ petition being WPA 8634 of 2025 is disposed of. There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
