The immediate grievance of the petitioner is that the appeal preferred by the petitioner under Rule 51 of the West Bengal Minor Minerals Concession Rules, 2016 being Appeal Case No.32 of 2023 challenging the order dated August 2, 2023 passed by the learned Additional District Magistrate & District Land & Land Reforms Officer, Paschim Medinipur has not been disposed of.

Mr. Chaturvedi, learned senior advocate appearing for the petitioner submits that the appeal is pending since the year 2023 and not a single date of hearing of such appeal has been fixed by the Divisional Commissioner, Medinipur Division before whom the appeal is pending. Mr. Galib, learned senior Government advocate submits that efforts will be taken to dispose of the appeal expeditiously.

Heard Mr. Saha, learned advocate for the respondent No.7.

Since the appeal is pending from the year 2023, this Court feels that the same should be disposed of expeditiously.

WPA 9156 of 2026 stands disposed of by directing the Divisional Commissioner, Medinipur Division, being the respondent No.3 to take up the hearing of the appeal being Appeal Case No.32 of 2023 and dispose of the same as expeditiously as possible after affording reasonable opportunity of hearing to the petitioner or his authorised representative and communicate the reasoned order to the petitioner as expeditiously as possible but positively on or before July 17, 2026 without granting any unnecessary adjournments to either of the parties.

There will be no order as to costs.
