1. The instant writ application has been filed, inter alia, challenging the order dated 3rd May 2018 passed by the Learned First Industrial Tribunal, West Bengal in case no. 1 of 2017.

2. Mr. Rakshit, learned advocate appearing for the petitioners, by placing an undated memorandum of settlement submits that the parties have resolved the disputes among themselves and as such, the writ application has become infructous.

3. The settlement however does not appear to be a settlement within the meaning of the Industrial Disputes Act, 1947.

4. Having regard to the aforesaid, without taking the aforesaid settlement on record, I am of the view, since, it is claimed that the writ application has been infructuous, let the writ application being WPA 7036 of 2018 be dismissed as infructuous, without any order as to costs.
