1. There is a CAN application filed for restoration. Prima facie from the averment made in the application itself it is obvious that the application has been filed in December, 2023 whereas the matter had stood dismissed for default on 22.01.2020.

2. We, however, find that there is no report of the department with respect to delay nor there is an application filed for condonation of delay stating therein the number of days of delay as per the appellant.

3. The application being CAN No. 2 of 2023 be tagged with the record and the application with file be sent to the Department for proceeding in accordance with law.
