Petitioner is aggrieved by the manner in which Polba Police Station case no. 193/23 dated 17.08.2023 has been progressing and to that effect approached this Court for transfer of investigation.

State has submitted a report. Report reflects that the police authorities arrested the respondent no.5, Pravas Das and consequent to his disclosures the name of one Dilip Majhi surfaced who signed the fake and forged deed. Notices were sent and there was recovery in respect of the documents relating to the fake and forged deed. Police authorities also were able to assess regarding the money which was received by different persons and consequently the said Dilip Majhi was also arrested. The documents which were seized were sent to QDEB, CID, West Bengal. The report which has been submitted before this Court is of 22.04.2024. The report reflects that police authorities had been taking steps in course of the investigation.

Neither the petitioner nor the learned advocate for the State is able to apprise the Court regarding the present status of the case.

In view of the fact that more than 22 months have passed since the case was registered for investigation, petitioner is granted liberty to call for a progress report before the learned A.C.J.M., Chandannagar. Learned A.C.J.M. will call for a progress report in case the investigation has not been completed and direct the superior officer of the police if required to monitor the investigation of the case. In the alternative if charge-sheet has already been submitted, petitioner would address his grievance by taking out an appropriate application under the provisions of law. Learned Magistrate would assess and ascertain regarding the nature of the allegations and if there are deficiencies in the investigation, pass necessary orders as he deems fit and proper.

With the aforesaid observations WPA 9415 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
