The matter was last heard on 29th July, 2022. No one appears today on behalf of the appellant. Mr. Banerjee, learned advocate appearing for the respondent submits that the appeal is time barred and that no application for condonation of delay has been served upon him. He further submits that a Money Execution Case has already been filed and adjournments are being sought for by the appellant submitting that the appeal is pending before this Court.
As no one appears on behalf of the appellant and no accommodation has been sought for, the appeal and the connected application are dismissed for default. The respondent would be at liberty to proceed with the Money Execution Case No.1 of 2015.
