Mr. Bidyut Kr. Halder Mr. Indranil Halder ...for the petitioner Mr. Subrata Das Gupta ....for the State Petitioner is aggrieved by the fact that in spite of information being furnished no action has been taken by the police authorities. Petitioner contends that he has approached before the jurisdictional Executive Magistrate under the provisions of Section 144 of the Cr.P.C. There was a direction upon the police authority is to ensure that no untoward incident takes place at the schedule premises.

As none appears on behalf of the State, Mr.

Subrata Das Gupta, learned advocate who ordinarily appears for the State is directed to represent the State. His appearance may be regularized by the concerned authorities.

An order under Section 144 Cr.P.C remains in existence for a period of sixty days. The misc. case

which has been referred to is of the year 2023. Accordingly, if any dispute, difference, harassment, obstruction is faced by the petitioner at the behest of the private respondent no.4, petitioner will file a fresh representation to the Officer-in-Charge, Kalighat Police Station who would assess regarding the accusations so made in the contents of the representation and decide the same in accordance with law. The concerned Officer-in-Charge will intimate the result of such consideration to the petitioner preferably within a period of four weeks from the date of receipt of such information/representation.

With the aforesaid observations WPA 8665 of 2023 is disposed of .

There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
