The writ petition has been filed complaining of an arbitrary appointment of 35 individuals as contractual Group-D workers in Agriculture Department, Government of West Bengal vide order dated 4th March, 2024.

On behalf of State the learned Advocate General assisted by Mr. Arindam Chattopadhyay submits that the said order dated 4th March, 2024 has been withdrawn by a subsequent order dated 25th April, 2024 and, as such, on merits the petitioner cannot have any grievance to be addressed. An order dated 25th April, 2024 passed by the Director of Agriculture, West Bengal filed in Court today is taken on record.

That apart it is submitted on behalf of the State that this Court does not possess the jurisdiction to receive, try and determine the writ petition in view of the provisions of Section 50 of the Administrative Tribunals Act, 1984.

Be that as it may, this Court through the learned Advocate General intends to pass on a message to the department concerned that they should be cautious before passing any order and if necessary should take the advice from the learned Advocate General to avoid unnecessary litigation and complication in future. Since the order under challenge has been withdrawn, nothing remains to be adjudicated in this writ petition. The same is accordingly disposed of. (Arindam Mukherjee, J.)
