WPA 6410 of 2020 with CAN 1 of 2020 (Old CAN 5017 of 2020) Sanjoy Halder & Anr.

-vsThe State of West Bengal & Ors.

Mr. Ayan Kumar Boral Mr. Anisur Rahaman ...for the petitioners Mr. Saikat Banerjee Mr. Ratul Biswas Mr. Kaushik Chowdhury ...for the WBBPE In the order dated 17.05.2023 the writ application number has been wrongly printed as WPA 6010 of 2020. This should be WPA 6410 of 2020. This rectification is to be read along with the order dated 17.05.2023.

The petitioners obtained qualification of D.El.Ed. 2017-2019 examination held in March, 2019.

The petitioners seek benefit as to their scale of pay etc. from the date of publication of the said training qualification result.

I direct the concerned District Inspector of Schools to hold a meeting within a period of six weeks from the date of communication of this order with the petitioners and the school authority and after such hearing the District Inspector of Schools will pass a

reasoned order by two weeks. The reasoned order is to be communicated to the petitioners by two weeks from the date of passing the said order. The petitioners are granted liberty to be represented by their learned advocates.

However, it is made clear that if the District Inspector of Schools thinks that the petitioners are entitled to get the scale of pay etc. from the date of attaining the qualification, he should not hesitate to pass such an order in favour of the petitioners. With the above observation and direction, this writ application is disposed of.

Accordingly, CAN 1 of 2020 is also disposed of. (Abhijit Gangopadhyay, J.)
