The instant application has been filed challenging an order dated 20th March, 2021, passed by learned Additional Sessions Judge, 1st Court, Sealdah, South 24 Parganas, rejecting the prayer for relaxation or modification of the conditions of bail filed by the petitioners.

It appears from the documents annexed by the petitioners along with the instant application that the petitioner nos.2 to 5 were granted bail by the learned Railway Magistrate, Sealdah in

connection with Chitpur GRPS Case No.03 of 2021 dated 13th February, 2021 under Sections 9/39/51 of the Wild Life Protection Act, 1972.

While granting bail, certain conditions were imposed by the learned Railway Magistrate, Sealdah.

As the bail was granted by the learned Magistrate upon certain conditions, he is the competent authority to relax the conditions.

In view of the above finding, the instant C.R.M. is not maintainable.

Accordingly, C.R.M.3381 of 2021 is dismissed. (Bibek Chaudhuri, J.)
