WPA 9082 of 2026 (Marfat Sk vs. State of West Bengal & Ors.) Mr. Raj Kr. Sain .... For the Petitioner Affidavit of service filed on behalf of the petitioner is taken on record.

None appears for the respondents despite service. The petitioner claims to be the recorded owner of the plot in question and alleges that the Zilla Parishad is constructing a road under 'Pathashree'

scheme by encroaching upon his land without acquiring the same by due process of law. The petitioner submitted a representation in this regard before the concerned authority which is yet to be considered. The petitioner seeks consideration of the same.

In view of the above, the Executive Officer, Murshidabad Zilla Parishad, being the 8th respondent herein, is directed to consider and dispose of the representation submitted by the petitioner dated 27th March, 2026 within six weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioner, in accordance with law. The concerned authority shall refrain from carrying out any further construction in the plot in question till disposal of the representation.

The writ petition is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
