Mr. Achyut Basu Ms. Punam Basu ..for the petitioners Mr. Debjit Mukherjee ..for WBSEDCL By filing the present writ petition, the petitioners have sought a direction upon the West Bengal State Electricity Distribution Company Limited (WBSEDCL) for the removal of high-tension electricity wires from their premises.
The affidavit-in-opposition filed by WBSEDCL, inter alia, states as follows:
(b) This deponent further states that properly sagged high-tension line is located along with the nearest main road and it is 200-250 meter distance from the building structure situated over the petitioner's land. Accordingly, the same cannot cause electrical hazards in terms of life and property.
(c) It is pertinent to mention here that a letter was received from the petitioner on 3rd
March, 2020 for shifting of the line. After receiving the said letter, the In-charge of the high-tension line visited the place along with this deponent. But, unfortunately on one was present on behalf of the Math. So, alternative route for line shifting has not been found.
Moreover, if the petitioner can show any alternative route, as per prevailing Rules, the petitioner have to bear the costs of shifting. It is also pertaining to mention here that if the line has to be shifted the life of nearby villagers as well as the daily life of the Math inhabitants might be impact."
In view of the stand taken by WBSEDCL, I do not find any justification to keep this writ petition pending. Accordingly, WBSEDCL is directed to notify the petitioners by fixing a fresh date for hearing. The petitioners shall be at liberty to participate in the hearing on the date so notified by the concerned officer of WBSEDCL.
Upon hearing the petitioners and all other relevant stakeholders, WBSEDCL shall take an appropriate decision regarding the shifting of the high-tension electricity wires, strictly in accordance with law. If, after such hearing, WBSEDCL finds it feasible to shift the high-tension wires, it shall issue a quotation for the requisite charges to the petitioners, who shall then deposit the said amount.
The entire exercise shall be completed within a period of three months from the date of communication of this order.
Accordingly, WPA 6425 of 2020 along with CAN 1 of 2020 (Old CAN 5045 of 2020) stands disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
