1. Present application has been moved for substitution of legal heirs of the sole petitioner late Sisir Saha who expired on 20th April, 2024. The death certificate has been filed on record.

2. Learned counsel submits that late Sisir Saha has left behind his wife namely Jyotsna Saha, son Pritam Saha and daughter Priyanka Adhikary as his only legal heirs and successors.

3. Learned counsel for the opposite party says that he has no objection.

4. In view of the submissions made the application is allowed.

5. Let the legal heirs be brought on record. Cause title be amended accordingly. Department is directed to amend the cause title.

6. CAN 1 of 2024 stands disposed of.

7. Learned counsel for the opposite party submits that another connected C.O. being No. 2754 of 2022 may also be tagged along with this petition for proper adjudication of the dispute.

8. Department is directed to list C.O. 1191 of 2024 and C.O. 2754 of 2022 together in the combined Monthly List of May, 2026.

9. Opposite party may file affidavit-in-opposition within two weeks with copy to the petitioner. Petitioner may also file reply, if any, within two weeks thereafter.
