1. Affidavit of service filed in Court today is taken on record.

2. The application of the petitioner seeking information under the provisions of the Right to Information Act was not responded to by the Information Officer.

3. The petitioner preferred first appeal against the same beyond the prescribed period of limitation for which the first appeal stood dismissed.

4. The petitioner thereafter preferred a second appeal which is alleged to be pending.

5. It appears that, admittedly, the first appeal was filed by the petitioner beyond the prescribed period of limitation and the same has been rightly dismissed by the first appellate authority.

6. It will be open for the petitioner to file a fresh application under the provisions of the Right to Information Act for obtaining the information in accordance with law.

7. The writ petition stands disposed of.

8. In view of the order passed hereinabove, the second appeal which is alleged to be kept pending becomes infructuous.

9. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
