Affidavit-of-service filed on behalf of the petitioner is taken on record.
Petitioner made application for transfer on general ground (distance) on 2nd June, 2022 on Utsashree portal and same was forwarded by the school authority, where petitioner is presently working on 5th July, 2022 to the concerned District Inspector of Schools (S.E.). The District Inspector of Schools (S.E.), Paschim Bardhaman in his turn has forwarded the transfer application of the petitioner upon processing the same through portal to the West Bengal Central School Service Commission on 7th July, 2022 for taking final decision. The grievance of the petitioner is in spite of receipt of transfer application far back on 7th July, 2022, West Bengal Central School Service Commission has not decided the transfer application finally.
Respondents are represented by learned advocates, who have jointly submitted that due to suspension of portal with effect from 29th September, 2022, contemporaneous decision could not be taken on transfer application of the petitioner.
On behalf of West Bengal Central School Service Commission, it is submitted that if concerned authority is directed, transfer application of the petitioner shall be decided, in accordance with law.
Having considered the submissions made on behalf of the parties, writ petition stands disposed of directing the Chairman, West Bengal Central School Service Commission being respondent no.4 to decide the transfer application of the petitioner by eight (8) weeks from the date of communication of this order and the decision to be communicated to the petitioner by ten (10) days thereafter.
However, it is made clear that transfer application of the petitioner shall not be rejected on the ground of suspension of portal.
Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
