No. 29 KAUSHIK REJECTED C.R.M.(A) 1546 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Chandipur Police Station Case No. 0065 of 2023 dated 03.03.2023 under Sections 447/323/325/307/354/379/ 506/34 of the Indian Penal Code, 1860.

And In Re : Nimai Barman ...... petitioner Mr. Prabi Kumar Mitra Mr. Pinak Kumar Mitra Ms. Ariba Shahab ....for the petitioner Mr. Neguive Ahmed Mr. Asif Dewan ....for the State In an incident of assault, the injured suffered open scalp wound at the right parital region of the scalp. The petitioner was identified as a person, who assaulted the victim.

In such circumstances, considering the gravity of the offence and the involvement of the petitioner in the incident, we are unable to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 1546 of 2023 is dismissed.
