Learned Counsel for the petitioner submits he is in custody for two years and five months. It is also submitted there is delay in trial. He prays for bail.

Learned Counsel for the State opposes the bail prayer and submits trial is in progress.

We have considered the materials on record.

Petitioner had assaulted the victim resulting in his death. Post mortem report notes injuries on the head of the victim. Offences, if proved, would attract mandatory life imprisonment of the petitioner. Trial is in progress. Accordingly, we are not inclined to grant bail to the petitioner.
