CAN 1 of 2020 (old CAN No.5068 of 2020) is disposed of by taking up the writ petition for consideration.
Petitioner seeks disconnection of electricity supply granted by the CESC authorities to the private respondent.
State, private respondent and the CESC authorities are represented.
Learned Advocate appearing for the private respondent submits that, the private respondent already applied for a fresh meter.
The private respondent is in settled possession. Private respondent is entitled to electric supply. Question of directing disconnection of electricity to the private respondent does not arise.
Private respondent applied for a new meter
connection. Therefore, in my view interest of justice would be subserved by directing the CESC authorities to provide a electricity supply to the petitioner through a new meter, upon the petitioner paying all costs, charges and expenses in respect thereof.
W.P.A. No.6437 of 2020 is disposed of.
No order as to costs.
