This is an application praying for expeditious disposal of the proceeding in Case No. C-242 of 2023 under Sections 138 and 141 of the Negotiable Instruments Act, 1881 presently pending before the learned Judicial Magistrate, 3rd Court, Barrackpore. Certified copy of order sheet is taken on record.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner filed a complaint in the year 2023. Yet, till date the proceeding could not be concluded. Accused had taken adjournments and were absent on certain dates. The proceeding has remained pending for no fault of the present petitioner. No prejudice will be caused to anyone, if a direction is passed to expedite the proceeding.

It appears that there is a delay in conducting the proceeding under Section 138 of the N.I. Act.

In view of the same and in the interest of justice, I request the learned trial Court to conclude the proceeding as expeditiously as possible, by keeping in mind the statutory stipulation contained in the said Act for an expeditious disposal.

With these observations, the revisional application is disposed of.
