The subject matter of this writ petition, arises out of dispute between the brothers. The petitioner prays for disconnection of the supply line, which was granted to the mother of the petitioner and the respondent nos.3 to 5. The respondent nos.3 to 5 are not present. They have refused service. Refusal is a good service.

It is submitted that two civil suits are pending between the heirs of the deceased consumer.

It is further submitted that the electricity authorities have not disconnected the supply line, despite the petitioner informing the authority that the mother/erstwhile consumer, had expired.

It appears that there are other children of the deceased. They are also using the electricity from the said connection. The petitioner claims ownership of the premises. Taking note of such dispute, mandatory orders cannot be passed.

Under such circumstances, the Station Manager Rajarhat Customer Care Centre will treat the writ

petition as the representation of the petitioner and dispose of the same in accordance with law, upon granting hearing to the petitioner as also the respondent nos.3 to 5. A reasoned order shall be passed and communicated to all, within a period of two months from the date of communication of this order.

6. The writ petition stands disposed of.

7. All the parties are directed to act on the basis of the server copy of the order.
