Learned advocate appearing for the petitioner challenges the continuance of the proceedings relating to Namkhana Police Station Case No.5 of 2020 dated 8.1.2020 wherein on conclusion of investigation, charge-sheet has been submitted before the jurisdictional court.

Ms. Faria Hossain, learned advocate, appears on behalf of the State and produces the case diary.

I have perused the materials appearing in the case diary. Petitioner has enclosed only the charge-sheet and other documents but the prosecution papers relating to the present case are not enclosed along with the revisional application. On an assessment of the materials, I am of the opinion that the revisional application has been preferred at a premature stage. Petitioner would be at liberty to canvass the points agitated in

the present revisional application at the stage of the consideration of charges and/or during the course of the trial of the case. With the aforesaid observations, CRR 1163 of 2021 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
