1. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the husband of the victim deceased. The petitioner has not committed any offence as alleged.

2. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail and points to the postmortem report. The FIR lodged by the mother of the victim and the statement of neighbours. He submits that the husband has remained absconding for about five years.

3. Considering the incriminating materials available in the case diary and the fact that the husband remained absconding for five years, I am not inclined to grant anticipatory bail to the petitioner.

4. Accordingly, the application for anticipatory bail is rejected.

5. Urgent Photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
