Rakib (Rejected) CRM (NDPS) 722 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Tapan Police Station case no. 150 of 2025 dated 08.03.2025 under Sections 21(c)/22(c)/23(c)/27A of the NDPS Act.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than one year. Report submitted by the State reflects that on the last occasion warrant, proclamation and attachment was issued against two of the accused persons.

Learned Special Court will exhaust such process of law and thereafter proceed for consideration of charges within a period of 60 days.

Next date has been fixed on 09.06.2026 by the learned Special Court. Accordingly, the investigating authority will submit a specific report regarding the whereabouts of the accused in the alternative file a report for non-execution.

Learned trial Court would split up the trial of the case and proceed to take steps.

Petitioner will be at liberty to approach this Court after the stage of consideration of charges is over.

At this stage, CRM (NDPS) 722 of 2026 is dismissed. Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
